Welcome to Fontana Coaching.

These Terms of Use (“Terms”) govern your use of the websites, landing pages, member areas, communities, forms, content, workshops, coaching services, and other services provided by Fontana Coaching Inc. (“Fontana Coaching,” “we,” “us,” or “our”).

By accessing or using our Services, registering for an event, creating or using an account, purchasing a program or membership, or participating in coaching with us, you agree to these Terms. If you do not agree, please do not use our Services.

These Terms should be read together with our Privacy Policy. If you enroll in a specific coaching program, group program, or membership, you may also be required to agree to additional program-specific terms or an agreement. If there is a conflict between these Terms and a program-specific agreement, the program-specific agreement will control for that program.

2. Eligibility and Accounts

Fontana Coaching Services are intended for adults age 18 and older. By using the Services, you represent that you are at least 18 years old and able to enter into a binding agreement.

Some Services, including private coaching, group programs, and membership, may require a GoHighLevel client or member login. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account.

You may not share, sell, transfer, or permit another person to use your account, member access, program materials, recordings, or login credentials without our prior written permission.

We may suspend, restrict, or terminate account access where reasonably necessary to protect our Services, clients, members, community, intellectual property, legal rights, or security.

3. Coaching and Educational Services

Fontana Coaching offers transformational coaching, educational workshops, memberships, group experiences, resources, and related support. Services may include, without limitation:

Free or paid workshops and events.
Clarity Calls.
Private coaching.
Group coaching.
Membership and community.
Client or member portals, materials, recordings, and resources.
Optional Voxer support, where expressly included in a program or agreed upon with an individual client.

Coaching is a collaborative, educational, and supportive process. You remain solely responsible for your own decisions, actions, relationships, health, finances, well-being, and results.

Fontana Coaching does not provide medical care, psychotherapy, mental-health treatment, crisis intervention, diagnosis, legal advice, financial advice, or other licensed professional services. Coaching is not a substitute for appropriate medical, mental-health, legal, financial, or other professional care.

If you are experiencing a medical emergency, mental-health crisis, or immediate risk of harm to yourself or another person, call 911, contact 988 in the United States for the Suicide & Crisis Lifeline, or contact an appropriate emergency or licensed professional resource. Do not use coaching, email, SMS, community spaces, or Voxer for emergency support.

We do not guarantee any particular personal, professional, relational, financial, business, health, or other outcome. Your experience and results depend on many factors, including your circumstances, participation, choices, effort, and actions.

4. Optional Voxer Support

Where Voxer support is expressly included in a program or separately agreed upon, it is an optional, asynchronous communication channel for coaching-related support.

Voxer is not monitored continuously and is not an emergency service. Fontana Coaching does not promise immediate responses. The scope, availability, and response expectations for Voxer support, if any, will be stated in the applicable program agreement, enrollment materials, or written communication with the client.

5. SMS Messaging Terms

If you choose to opt in to receive text messages from Fontana Coaching, you agree to receive recurring automated text messages at the mobile phone number you provide.

Messages may include workshop or appointment reminders, scheduling information, service-related updates, membership or client communications, and—where you have provided the appropriate consent—occasional marketing or promotional messages about Fontana Coaching Services.

Consent to receive marketing text messages is not a condition of purchasing any Fontana Coaching Service. Message frequency varies. Message and data rates may apply.

You may opt out of SMS messages at any time by replying STOP to a message you receive from us. You may reply HELP for assistance or contact us at [email protected] or 508-978-7875.

Message delivery may be delayed, unavailable, or affected by factors outside Fontana Coaching’s control, including mobile-carrier or network availability. We are not responsible for delayed or undelivered messages.

6. Purchases, Payment Plans, and No-Refund Policy

Prices, payment options, and what is included in a Service will be presented before purchase, in the applicable checkout page, invoice, payment receipt, enrollment materials, or program agreement.

Unless otherwise stated in writing, all purchases of Fontana Coaching programs, coaching services, memberships, events, digital materials, and related Services are final and non-refundable.

Coaching Programs and Payment Plans

If you enroll in a coaching program and select a payment plan, you are responsible for paying the full program investment according to the selected payment schedule, regardless of your participation level, completion of the program, early termination, or decision not to use scheduled sessions, materials, or support.

If a payment is declined, missed, reversed, disputed, or otherwise not received when due, Fontana Coaching may, to the extent permitted by law:

Pause or revoke access to your client portal, member area, community, materials, recordings, and other program resources.
Cancel or pause future coaching sessions, appointments, or support.
Require the account to be brought current before Services resume.
Seek payment of the remaining unpaid balance and reasonable costs of collection where permitted by law.

Memberships and Recurring Payments

If you enroll in Entelechy Code or another recurring membership, you authorize Fontana Coaching and its payment processor to charge the payment method you provide at the price and billing interval disclosed at checkout, unless and until you cancel.

You may cancel your membership at any time before your next billing date. Upon cancellation, you will retain access through the end of your already paid billing period. You will not receive a refund for payments already made, including for partial billing periods, unless required by applicable law.

Founding Member Pricing

If you enroll at a founding-member or other promotional membership rate, that rate applies only while your membership remains active, your account remains in good standing, and your recurring payments remain current.

If you cancel, allow your membership to lapse, or are removed from the membership for nonpayment or violation of these Terms, your founding-member or promotional rate ends. If you later rejoin, your membership will be offered at the standard rate then available, unless Fontana Coaching expressly agrees otherwise in writing.

7. Scheduling, Rescheduling, and Missed Sessions

For private coaching, you are responsible for attending your scheduled Zoom session at the agreed time using the connection details provided to you.

If you need to reschedule a private coaching session, please provide at least 24 hours’ notice.

If you have an emergency or illness, you may request to reschedule with less than 24 hours’ notice. We will make reasonable efforts to accommodate genuine emergencies or illness, but accommodation is not guaranteed.

If you miss a scheduled session without notice, that session is considered used and will not be made up.

If Fontana Coaching needs to reschedule a session, we will provide at least 24 hours’ notice when reasonably possible, except in an emergency or illness.

Specific program agreements may include additional scheduling rules, program periods, expiration dates, or session-use terms.

8. Client Portals, Memberships, and Community Conduct

Private clients may receive access to a GoHighLevel-hosted client portal or login. DreamBuilder group participants may receive access to a GoHighLevel-hosted member area or community when included in the applicable program. Entelechy Code includes a GoHighLevel-hosted member login and community.

You are responsible for maintaining the confidentiality of other participants’ personal information, stories, reflections, communications, and other content shared in a group program or membership community. You may not record, copy, screenshot, download, reproduce, distribute, publicly share, or use another participant’s content, name, likeness, story, or personal information without that person’s separate permission.

You agree not to use any client portal, membership area, community, call, or support channel to:

Harass, threaten, shame, discriminate against, defame, exploit, or harm another person.
Post unlawful, fraudulent, abusive, obscene, or infringing material.
Share another person’s confidential information.
Advertise, promote, solicit, or sell goods or services without written permission from Fontana Coaching.
Upload malicious code, attempt unauthorized access, or interfere with the security or operation of the Services.
Use the community, client information, member information, or program materials for commercial, competitive, or unauthorized purposes.

We may remove content, restrict participation, suspend access, or terminate access if we reasonably believe these Terms have been violated or action is needed to protect participants, members, clients, Fontana Coaching, or the integrity of the Services.

9. Recordings and Program Materials

We may record workshops, private coaching sessions when agreed upon with the client, and group or membership sessions when applicable. Zoom may also generate transcripts or AI-based meeting notes, including through Zoom Notes or similar features.

Workshop recordings may be provided to people registered for the applicable workshop, including registrants who did not attend live. Group and membership recordings may be made available to eligible participants or members for program delivery and continuity.

You may not record, copy, reproduce, distribute, publish, sell, share, publicly display, or create derivative works from any Fontana Coaching workshop, call, session, recording, transcript, course material, resource, community content, or other program material without our prior written permission.

We will not use your recording, transcript, screenshot, testimonial, community post, or other identifiable content for marketing or promotional purposes without your separate, explicit permission.

10. Intellectual Property

All materials and content provided through Fontana Coaching Services—including the Fontana Coaching name and logo, website content, text, graphics, designs, videos, audio, recordings, frameworks, workshop materials, program resources, exercises, course materials, emails, and other original content—are owned by or licensed to Fontana Coaching and are protected by applicable intellectual property laws.

Subject to your compliance with these Terms and any program agreement, Fontana Coaching grants you a limited, personal, non-transferable, non-commercial, revocable license to access and use purchased or provided materials for your own personal use during the access period offered for the applicable Service.

You may not copy, modify, reproduce, republish, sell, sublicense, distribute, teach, create derivative works from, or commercially exploit Fontana Coaching materials without prior written permission.

Nothing in these Terms transfers ownership of Fontana Coaching intellectual property to you.

11. Your Content and Testimonials

You retain ownership of original content you personally submit to a client portal, community, form, or communication channel.

By submitting content to a private client portal, group community, or membership community, you give Fontana Coaching a limited, non-exclusive permission to host, display, and use that content only as necessary to operate and provide the applicable Services.

You are responsible for ensuring that content you submit does not violate any law, infringe another person’s rights, or violate these Terms.

We will request separate, explicit permission before using your name, likeness, testimonial, review, recording, screenshot, or other identifiable content for marketing or promotional purposes.

12. Third-Party Platforms and Links

Our Services may rely on third-party platforms or include links to third-party websites and services, including GoHighLevel, Stripe, Zoom, Voxer, Meta platforms, or other resources.

We do not control and are not responsible for third-party websites, platforms, products, services, content, availability, security, or privacy practices. Your use of those services is subject to their own terms and policies.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Services, content, materials, portals, communities, and resources are provided on an “as is” and “as available” basis.

Fontana Coaching does not guarantee that the Services will be uninterrupted, secure, error-free, available at all times, or free from viruses or harmful components. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement, except where such warranties cannot legally be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, Fontana Coaching Inc. and its owners, employees, contractors, agents, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, income, data, goodwill, opportunity, or personal outcomes, arising out of or related to your use of the Services.

To the fullest extent permitted by law, Fontana Coaching’s total liability for any claim arising from or related to the Services will not exceed the amount you actually paid to Fontana Coaching for the specific Service giving rise to the claim during the 12 months before the event giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded under applicable law.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Fontana Coaching Inc. and its owners, employees, contractors, agents, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, unlawful conduct, infringement of another person’s rights, or misuse of the Services.

16. Suspension and Termination

We may suspend or terminate your access to the Services, client portal, membership, community, or program materials if you violate these Terms, fail to make a required payment, misuse the Services, create a risk to another person or the community, or engage in unlawful, abusive, or harmful conduct.

Termination or suspension of access does not eliminate your obligation to pay any balance you agreed to pay for a coaching program or other Service, except where required by applicable law or expressly agreed by Fontana Coaching in writing.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business practices, Services, technologies, or legal requirements.

When we make changes, we will revise the Effective Date at the top of these Terms. Updated Terms will apply from the date they are posted on our websites or Services, unless otherwise required by applicable law.

We encourage you to review these Terms periodically.

18. Governing Law and Severability

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
